This is a common question and a legitimate concern for most personal injury victims considering a negligence claim or lawsuit. Unfortunately, the answer can vary widely based on certain circumstances.  In most cases, the length of time needed to resolve a claim will depend on the time needed for the client to complete medical treatment.  However, Florida Law places a time limitation often referred to as the “Statute of Limitations” on all claims.  For a standard negligence action it is four years but if you are suing your own insurance company for breach of contract, the Statute of Limitations allows five years from the date of the event.

 An Immediate Investigation is Critical

How Long Will My Personal Injury Case Take?No one can be sure exactly how long a claim may take.  But if certain steps are not taken timely, you can guarantee your case will continue much longer than it should.  That is why it is so important to have your accident attorney complete a thorough investigation timely and immediately after your injury. In addition to investigating liability, your personal injury attorney should also conduct an immediate investigation into the availability of insurance coverage so as to avoid potential problems and delays during your case. If the Liability and Insurance Investigation is completed timely and properly, your attorney should be in a position to present a demand package to the necessary insurance companies at the time your diagnosis is clear. Once the Demand is submitted, the case should either resolve quickly through negotiation or litigation must follow.  

What If Negotiations Aren't Successful?

If negotiations are not successful and your attorney files a lawsuit on your behalf, it is important to aggressively pursue the litigation.  Once in suit, your attorney may file a notice for trial in order to expedite your case coming before a judge or jury for final resolution. While the case is in suit each party has an opportunity to investigate further through interrogatories, request for production, request for admission, deposition, and subpoena. This process can take months and sometimes years depending on the complexity of your case.

The Judge will Require the Attorneys to Work Diligently

Regardless, once your claim is in suit, the judge will require the attorneys from each side to work diligently in moving the case forward and will require a mediation conference where both parties meet to discuss a negotiated settlement. If mediation is not successful, the case will be moved to trial and can last days or months. Often a trial will provide finality for the case but each party may appeal certain rulings by the court as well as the ultimate outcome which can delay the case months if not years and can require the trial to occur base at that time.
