What They'll Ask For

The insurance company often asks for medical records and medical information for as much as 5 to 10 years before the accident. You do not have to provide it in every situation. When you do provide it, you are permitted to limit their inquiry.

For instance, if you have injured your knee in a motor vehicle accident, there is no good reason for the other party’s insurance company or your insurance company to obtain psychological or psychiatric medical records from your past. This is simply over broad and over reaching.

When To Sign Medical Authorizations

Also, the insurance company that represents the negligent driver, is not entitled to obtain your medical records at all. Your own insurance carrier may have certain policy provisions that require you to sign a medical authorization. However, you should not do so with out qualified legal representation and advice.

Do not allow any insurance company to engage in a “fishing expedition" and have unbridled and unlimited access to your medical information. It is simply not in your best interest nor is it required.
